Acceptable Use Policy

Purpose

This Acceptable Use Policy ("AUP") outlines the rules and guidelines for using the Prospecco platform and services. It is designed to protect our users, maintain the quality of our data enrichment services, and ensure compliance with applicable laws. This AUP forms part of our Terms of Service.

Prohibited Activities

You must not use the Prospecco platform or any data obtained through it for the following purposes:

Spamming and Unsolicited Communications

  • Sending bulk unsolicited emails, messages, or communications to individuals whose data was obtained through our platform
  • Using enriched contact data for cold outreach that does not comply with applicable anti-spam laws (including CAN-SPAM, GDPR, and PECR)
  • Creating or distributing email lists for the purpose of spamming or phishing

Excessive Scraping and Data Collection

  • Scraping, crawling, or harvesting data from the Prospecco platform beyond the scope permitted by your subscription and API rate limits
  • Using automated tools to extract data in a manner that degrades the performance or availability of our services
  • Systematically downloading or caching enrichment results to build a competing database

Harassment and Abuse

  • Using data obtained through Prospecco to harass, stalk, threaten, or intimidate any individual
  • Engaging in any form of discriminatory targeting based on protected characteristics
  • Impersonating any person or entity, or misrepresenting your affiliation with any person or entity

Illegal Activities

  • Using the platform for any activity that violates applicable local, national, or international law
  • Processing personal data in violation of data protection laws, including the GDPR, CCPA, or other applicable regulations
  • Using enriched data to facilitate fraud, identity theft, or any other criminal activity

Unauthorised Reselling and Redistribution

  • Reselling, sublicensing, or redistributing data obtained through Prospecco without explicit written authorisation
  • Providing access to enriched data to third parties outside your organisation without a valid data sharing agreement
  • Repackaging Prospecco data as part of a competing data enrichment or lead generation service

Circumventing Technical Restrictions

  • Attempting to bypass rate limits, usage quotas, or other technical restrictions on the platform
  • Using multiple accounts to circumvent usage limits or subscription restrictions
  • Interfering with or disrupting the integrity or performance of the Service or the data contained within it

Fair Usage

To ensure the quality and availability of our services for all users, Prospecco applies fair usage policies:

  • API rate limits are applied per account and are detailed in our API documentation
  • Bulk enrichment operations should be performed using our batch processing tools rather than sequential individual requests
  • Excessive or abusive usage patterns may result in temporary throttling to protect platform stability
  • We reserve the right to adjust fair usage thresholds and will communicate changes in advance

Monitoring and Enforcement

Prospecco monitors usage patterns to detect violations of this AUP. Our monitoring includes:

  • Automated detection of unusual API usage patterns, bulk download activity, and suspicious account behaviour
  • Review of reports submitted by users, data subjects, and third parties
  • Periodic audits of how enriched data is being used where there are reasonable grounds for concern

We take a proportionate approach to enforcement and will generally issue warnings before taking more severe action, except in cases of clear malicious intent or legal violation.

Consequences of Violation

Violations of this AUP may result in one or more of the following actions, depending on the severity and nature of the violation:

  • Warning: A written notice identifying the violation and requesting corrective action
  • Temporary suspension: Suspension of your account or API access while the violation is investigated
  • Permanent termination: Termination of your account and forfeiture of unused credits
  • Legal action: Referral to law enforcement or initiation of legal proceedings where the violation involves illegal activity

We will provide you with an opportunity to respond to allegations before taking permanent action, except where immediate action is necessary to prevent harm or comply with legal requirements.

Reporting Abuse

If you become aware of any misuse of the Prospecco platform or data obtained through it, please report it to us immediately. We take all reports seriously and will investigate promptly.

When reporting abuse, please include as much detail as possible, including the nature of the abuse, any relevant evidence, and the identity of the parties involved (if known).
